General Warranty Terms and Conditions
1. Statutory Rights Under the Australian Consumer Law
The Australian Competition and Consumer Act 2010 (including the Australian Consumer Law), together with other applicable laws in Australia, provides certain guarantees in relation to the supply of goods. These guarantees cannot be excluded.
-
Major Failure — If a failure to comply with a guarantee is classified as a major failure (including, but not limited to, where the goods are unsafe, substantially unfit for their intended purpose, or significantly different from their description), you are entitled to choose a replacement or refund. You may also be entitled to claim compensation for any other loss or damage that is reasonably foreseeable as a result of the failure.
-
Minor Failure — If the failure does not constitute a major failure, you are entitled to have the goods repaired or replaced.
Nothing in this warranty limits or excludes your rights under the Australian Consumer Law.
2. Additional Warranty Benefits
(a) This warranty provides additional protection for your UNIMIG product beyond your statutory rights, offering a streamlined and efficient claims process.
(b) Any warranties or conditions not guaranteed under the Australian Consumer Law or expressly set out in this document are excluded to the fullest extent permitted by law.
(c) This warranty does not replace or limit your statutory rights.
3. Governing Law
This warranty is governed by the laws in force in the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of the courts of any State or Territory of Australia.
4. Authority
No employee, agent, or representative of UNIMIG is authorised to vary or amend the terms of this warranty.
5. Effective Date and Updates
These warranty terms and conditions, effective 30 February 2025, replace all previously issued warranties and publications. UNIMIG may amend these terms from time to time, with the latest version available at www.unimig.com.au/warranty-terms
6. Warranty Period and Parts Coverage
(a) Warranty coverage commences on the date of purchase and does not restart after a repair or replacement.
(b) Replacement parts supplied under warranty are covered for the greater of: (i) the unexpired balance of the original warranty period applicable to the product; or (ii) twelve (12) months from the date of replacement.
